Sierra Verde is a single-family home subdivision in Surprise, AZ (near Phoenix), governed by a homeowners association (HOA). These Covenants, Conditions, and Restrictions (CC&Rs) apply to all lot owners, residents, and guests, and establish rules for property use, maintenance, and assessments.
- Residential use & home businesses: Lots are for single-family residential use only. Home businesses are allowed if they comply with local municipal ordinances for home businesses in residential districts. No commercial activity is otherwise permitted.
- Leasing & rentals: Leases must be in writing, for the entire residence and lot, and have a minimum term of 30 days. No maximum term is specified. Model homes and sales offices are exempt.
- Pets: Household pets (dogs, cats, etc.) are allowed but only types and breeds determined acceptable by the Board. No commercial breeding; no unreasonable numbers as determined by the Architectural Committee. Pets must be kept in a fenced yard or on a leash. Structures visible from neighboring property are prohibited.
- Parking & vehicles: Vehicles must be parked in garages or driveways; no overnight on-street parking. Prohibited: trucks over 1 ton, motor homes, trailers, boats, commercial vehicles, and inoperable vehicles visible from neighboring property or common area. Temporary parking of guest vehicles is limited to 7 days per 6-month period. Towing is authorized for violations.
- Architectural review & exterior changes: All exterior improvements, alterations, and landscaping require prior written approval from the Architectural Committee. Includes buildings, fences, signs, antennas, satellite dishes (subject to federal regulations), basketball goals, playground equipment, and lights. Approval is deemed granted if the Committee fails to act within 60 days of a complete application.
- Assessments & fees: Annual assessments start at $480 per lot ($40/month) and can increase annually by the greater of 10% or CPI-based adjustment, but no more than 20% year-over-year without majority approval. Special assessments require two-thirds vote. A transfer fee (amount set by Board) is due from each new purchaser. The first purchaser after construction pays an additional two months of annual assessment into reserves.
- Air Force base proximity: The property is near Luke Air Force Base. Owners grant a perpetual avigation easement for aircraft overflights and release the Air Force, City of Surprise, and developers from liability for noise, vibration, fumes, etc., but not for damage from falling aircraft or objects.
