This is a partial amendment to the Declaration of Covenants, Conditions, and Restrictions (CC&Rs) for Bell Creek Townhomes, also known as Mission Village Townhomes, a townhome/attached community in Phoenix, AZ. The document does not contain the full rules of the community—it only adds a new section granting the developer reduced assessments and annexes additional lots (Phases II, III, and IV) into the association. The full CC&Rs and prior amendments remain in effect.
- Developer rights & assessments: The developer (Sierra Acquisitions, L.L.C.) has the same voting rights as a Class A member (owner) but pays reduced assessments of 25% of the annual assessment per unit until an occupancy permit is issued or the unit is sold to a third party. Assessments on annexed lots begin once the first construction permit is issued for those lots.
