What Bell Road Office Plaza's governing documents say
Bell Road Office Plaza is a two-unit commercial condominium in Phoenix, AZ. You own the interior of your unit and share ownership of the common elements (building structure, common areas) with the other unit owner. The association maintains common elements and carries master insurance, funded by per-unit assessments. This declaration governs use and maintenance of the property — it is not a residential community.
- Permitted use (commercial only): Units may be used exclusively for commercial and professional office purposes, consistent with zoning. No residential, retail, or other use is allowed.
- Leasing & rentals: Leases must be in writing, subject to the declaration and rules. The unit owner must notify the association at least 10 days before lease start, providing tenant names, contact info, and an emergency contact. The owner is liable for tenant violations.
- Pets & animals: No animals, birds, reptiles, fowl, poultry, or livestock are permitted anywhere on the property.
- Parking & vehicles: Each unit has assigned covered parking spaces (limited common elements). No inoperable vehicles, trucks, trailers, campers, boats, or recreational vehicles may be parked or stored. The association may tow violating vehicles at the owner's expense.
- Alterations & improvements: Nonstructural interior alterations do not need prior approval, but structural changes require board approval and an engineer's certificate. Any alteration visible from the exterior also requires board approval. The owner must carry $2,000,000 liability insurance and 100% replacement cost property insurance before starting work.
- Assessments & fees: Common expense assessments are allocated per unit's square footage (Unit 1: 45.6%, Unit 2: 54.4%). Budgets are set by the board; special assessments over $0 require approval of two-thirds of votes (one vote per unit). A transfer fee is charged upon unit sale, set by the board.
- Insurance: The association carries property insurance on the building (excluding interior finishes and owner additions) and liability insurance (minimum $1M per occurrence). Each owner should insure personal property, additions/improvements, and personal liability.
- Maintenance responsibilities: The association maintains and repairs all common elements. Each unit owner maintains their own unit and limited common elements (e.g., parking spaces, utility fixtures serving only their unit). Unit 1 also maintains the attached drive-through canopy.
