Bellair is a standard single-family home subdivision in Phoenix, AZ, governed by a homeowners' association (Bellair Homeowners Association). The Declaration of Covenants, Conditions and Restrictions (CC&Rs) is the rulebook binding all lot owners. It covers assessments, architectural control, exterior maintenance, and use restrictions for lots and common areas.
- Membership & voting: Every lot owner is a member. There are two classes: Class A (all owners except developer, one vote per lot) and Class B (developer, three votes per lot until Class A votes equal Class B or May 1, 1980, whichever comes first).
- Assessments: Annual assessments (initially max $96 per lot, may increase up to 5% yearly without vote; above that requires 2/3 vote of each class) and special assessments for capital improvements (requires 2/3 vote). Unpaid assessments bear 6% interest and become a lien on the lot.
- Architectural review: No building, fence, wall, or exterior alteration may begin without written approval from the Board or an architectural committee (3+ members). Plans are deemed approved if no decision within 30 days of submission.
- Exterior maintenance: Each lot owner must maintain the premises and exterior of improvements (roofs, walls, windows, landscaping, etc.) per Association rules. If owner defaults after 30 days' notice, Association may enter and correct, charging costs as a lien.
- Use restrictions: Dogs and cats allowed but not for commercial purposes and must not annoy neighbors. No advertising signs except one 'for sale' or 'for rent' sign under 4 sq ft. No business activities on lots. Clotheslines confined to rear yards. Rubbish must be regularly removed. No vehicles over 3/4 ton in front yards; no recreational vehicles or boats in front/side yards. No abandoned or inoperable vehicles visible from other lots or streets.
- Common area: Common area (tracts listed) is owned by the Association for owner use. Association may charge fees for recreational facilities, suspend voting/use rights for unpaid assessments (or up to 60 days for rule infractions), and dedicate common area with 2/3 vote of each class.
