Cactus Point Crossing is a single-family home subdivision in Peoria, AZ. These CC&Rs (Covenants, Conditions, and Restrictions) are the rulebook for all lot owners, covering use, maintenance, design standards, and shared responsibilities. The document binds owners and their tenants, guests, and successors.
- Residential use only: All lots must be used as single-family residences. No commercial, professional, or trade activity is allowed on any lot, except temporary facilities needed for construction and sales by the developer.
- Building & lot standards: Only one detached single-family residence per lot, max two stories, plus a three-car garage. No prefabricated structures visible from neighboring property without committee approval. Temporary structures (e.g., construction trailers) must be removed after completion. Landscaping must be completed within six months of closing and maintained in harmony with the subdivision.
- Architectural review: Any exterior construction, alteration, or addition (including solar panels, antennas, and HVAC) requires written approval from the Design Review Committee. Plans must show nature, kind, color, shape, height, materials, and location. The committee has 45 days to respond; if no response, approval is deemed granted.
- Leasing restrictions: Leases must be in writing, for the entire residence and lot, and have a minimum term of 30 days.
- Parking & vehicles: Vehicles must be parked in garages or residential driveways. No trucks over 3/4 ton, campers, boats, RVs, or inoperable vehicles may be parked visible from neighboring property (exceptions for smaller pickups and mini-motor homes under 7 ft height and 18 ft length). No vehicle repair or construction on front lots or streets.
- Pets: Only a reasonable number of common household pets are allowed, kept as domestic pets only, not for commercial purposes. No nuisance noise or unsanitary conditions. Pet structures must not be visible from neighboring property.
- Party walls: Walls or fences on lot dividing lines are party walls. Each owner maintains the exterior surface facing their lot. Repair costs are shared equally unless damage is caused by one owner, who then bears full cost. Entry for repairs is permitted with advance notice (immediate in emergencies). Alterations require adjoining owner's written consent.
- Maintenance obligations: Each owner must keep their residence, lot, and landscaping in good repair and attractive condition. During prolonged absence, arrange for continued care. Failure to maintain may allow the Design Review Committee to perform work and charge the owner, plus 18% annual interest, with a lien on the lot.
