What Talara's governing documents say
Talara is a single-family home HOA in Phoenix, AZ (part of the Los Portones master association). The CC&Rs govern the 104 lots, require single-family residential use, and are enforced by the Talara Homeowners' Association. All owners are members and subject to assessments, architectural control, and use restrictions.
- Single-family residential use: Each lot may have only one single-family residence plus a private garage. No commercial activity, further subdivision, or condominium conversion is allowed without Board approval.
- Architectural review: Any exterior alteration, construction, fence, wall, or change in color or materials requires prior written approval from the Architectural Control Committee, which has broad discretion over aesthetics and harmony with surroundings.
- Parking & vehicles: Vehicles must be parked in garages, driveways, or designated areas; on-street parking is discouraged. No vehicle over 3/4 ton, mobile home, boat, trailer, or camper may be visible from neighboring property, common areas, or streets, except certain pickups and mini-motorhomes under specified dimensions. Garages cannot be converted to living space.
- Signs: Only one name/address sign (max 9" x 30") and one temporary sale/rent sign (max 5 sq. ft.) are permitted per lot. Builder signs during construction are allowed.
- Pets: Only a reasonable number of domestic house or yard pets may be kept, not for commercial purposes. They must not create excessive noise or nuisance. The Board can decide what is reasonable and whether an animal qualifies as a pet.
- Assessments: Annual assessments are set by the Board per lot, initially capped at $19.50/month per lot until 1994, then adjusted annually by CPI without member vote. Increases above the CPI cap require a 2/3 vote of each membership class. Special assessments for capital improvements also require 2/3 approval. Unpaid assessments become a lien on the lot.
- Party walls & fences: Contiguous lot owners share equal rights and maintenance obligations for party walls/fences. Damage caused by one owner must be repaired at that owner's cost; otherwise, costs are shared equally. Disputes are resolved by the Board.
