Desert Stone Condominium Association is a 55+ age-restricted community in Sun City West, Arizona, consisting of garden homes and duplexes (36 units). Unit owners own their individual homes but the association maintains all common areas, exterior surfaces, and landscaping, funded by monthly per-unit assessments. At least one occupant must be at least 55 years old, and no person under 19 may reside in the community.
- Age restriction (55+): At least one occupant must be 55 or older. Critically: no person under 19 years old may reside in any unit, which includes children, grandchildren, and anyone else under that age.
- What you own & maintain: You own your unit's interior. The association maintains all exterior surfaces (excluding glass), common areas, landscaping, shared yards, and recreation facilities. You are responsible for your interior, patios, appliances, heating/AC systems, and termite control.
- Leasing & rentals: Leasing is generally prohibited. Original owners (as of this 2008 amendment) may rent their units, but this right ends if they sell. The Board may permit temporary leases in hardship cases (death, illness, job transfer). All leases must comply with the Declaration and tenants must receive a copy of governing documents.
- Pets: A reasonable number of domestic pets are allowed. Pets must be kept on a leash when outside dwelling units and may not make unreasonable noise or become a nuisance.
- Vehicles & recreational equipment: Boats, trucks, trailers, campers, RVs, and commercial vehicles cannot be stored on property for more than 72 hours without Board permission. No vehicle may be used as a living space.
- Architectural review & exterior changes: Any exterior modifications—painting, landscaping, structures, fences, satellite dishes, antennas—require written Board approval before work begins. The Board has 30 days to review; if it does not respond, approval is deemed granted. TV antennas are capped at 5 feet above roofline; ham radio antennas are prohibited.
- Party wall maintenance (duplexes): Shared walls between duplexes are jointly maintained and repaired at equal cost. Structural changes require Board approval and written consent from the adjacent owner. If damage is caused by one owner's negligence, that owner bears the full repair cost.
- Recreation Center membership & annual fee: Ownership includes mandatory participation in Sun City West Recreation Centers (golf courses, recreation centers, library, parks). An annual assessment must be paid at closing and each year thereafter, and annual membership is required for all occupants.
