What Calle De Caballos's governing documents say
Calle de Caballos is a single-family residential subdivision in Tempe, Arizona, explicitly designed for equestrian living — you own a house on your lot, but must maintain at least 50% of the lot area for keeping horses. The homeowners association, funded by per-lot assessments, enforces design and land-use rules to preserve the community's horse-centered character.
- Equestrian requirement & horse keeping: At least 50% of each lot must be kept and maintained for equine domestic stock. The community is intended for horsemen; horses must be cared for in a clean, orderly fashion, and animal feces cannot be dumped on common areas without immediate tilling into the ground. Swine are not permitted.
- What you own & maintain: You own one single-family residence per lot (minimum 2,500 sq ft for one-story, 2,000 sq ft for two-story), plus one guest house, garages, barns, stables, and tack-rooms. You maintain all structures on your lot; the association maintains common areas, equestrian trails, and utility easements.
- Building & design approval: All structures must be new construction and approved by the Board before building. The Board reviews design, materials, location, color, and landscaping. Homes must be at least 20 feet from front/side lot lines; barns at least 50 feet from the house. Existing structures are grandfathered under the 50% equine-area rule.
- Lot restrictions: Lots cannot be subdivided into smaller parcels. No mobile homes without Board approval. No commercial uses, boarding houses, hotels, guest ranches, or any business that violates city codes.
- Fencing & animal containment: All animals must be fenced, caged, or controlled. No barbed or strand wire permitted; block walls require Board approval. Grazing areas must be enclosed with fencing that extends to the front lot line.
- Parking & vehicles: Only private passenger automobiles and pickup trucks permitted. Non-operating vehicles must be in an enclosed garage. Parking areas must comply with setback requirements and Board approval.
- Assessments & enforcement: All owners pay annual per-lot assessments at a uniform rate, approved by at least 50% of homeowners. Delinquent assessments accrue 10% annual interest plus attorney fees and court costs. The association can suspend your common area privileges or foreclose on your lot to collect unpaid assessments.
- Membership & voting: Each lot owner automatically becomes an association member with one vote per lot (fractional votes not allowed). The Board has 3–6 directors elected for 2-year terms. The Board has broad authority to interpret and enforce the covenants.
