Carefree Rolling Hills is a standard single-family home subdivision in Phoenix, AZ. All homeowners automatically become members of the Carefree Rolling Hills Improvement Association, which maintains entry gates and common areas and enforces use and architectural rules.
- Membership & voting: Each lot owner automatically gets one membership in the association and one vote per lot owned. Voting rights are suspended if assessments are unpaid for 15 days or other defaults for 15 days.
- Use restrictions: Lots are for single-family residential use only. Guest houses are allowed for non-paying guests. No temporary buildings, tents, or trailers. Only common household pets (no horses, livestock, or poultry). Signs limited to one 'For Sale' or 'For Rent' sign up to 3 sq ft. No commercial businesses. All utility lines must be underground.
- Recreation area (undeveloped): Lot 1 is designated as a potential recreation area for common use (e.g., tennis court, pool, clubhouse), but the Declarant does not intend to develop it. The association had a 3-year option to purchase Lot 1 at the original price of Lot 2; otherwise, it may be sold for residential use.
- Architectural review: All construction, fences, walls, and exterior alterations require approval by the Architectural Control Committee. Key standards: maximum wall height 20 ft, ridge height 15 ft; minimum ground floor living area 1,800 sq ft (excl. porches, patios, carports, garages); setbacks at least 40 ft front/back and 30 ft side; no chain-link fences; roofs must not be white, silver, or highly reflective; exterior lighting must not be directed at streets or other lots; all vehicles (including boats, trailers) must be in garage/carport.
