What Carver Hill's governing documents say
Carver Hill is a single-family home HOA in Laveen, AZ, established to maintain a private water well and preserve the rural, equestrian character of the neighborhood. All owners automatically become members and must pay annual assessments and special assessments, which are liens on the property.
- What you own & maintain: You own your lot and home (must be a permanent, site-built residence). The association maintains the common area (including the water well, well site, and gravel roads) but does not pave roads.
- Use restrictions: No mobile homes, manufactured homes, or factory-built buildings are allowed. Temporary occupancy (RVs, tents, etc.) is prohibited. Businesses are allowed only if they comply with zoning, don't involve door-to-door solicitation, and aren't a nuisance.
- Assessments & fees: Annual assessments are set by the board and can be increased up to 20% per year without owner vote, above 20% requires majority approval. Special assessments require majority approval. There is a one-time membership fee for new parcels to connect to the well water system.
- Water & well: Each parcel is entitled to water from the association's private well for household, landscaping, and limited business use. The board may adopt rules limiting water use. If public water becomes available, the well may be decommissioned with 80% owner approval.
- Architectural & construction: Homes must be permanent structures—no mobile or manufactured homes. Temporary buildings during construction must be removed after completion. The document does not specify an architectural review committee but the board may adopt rules for improvements.
- Voting & governance: Each parcel gets one vote. No cumulative voting. Voting rights are suspended if assessments are delinquent. Amendment of use restrictions (Article 3) requires 90% approval; other amendments require 67% approval.
- Enforcement & liens: The association or any owner can enforce restrictions. Unpaid assessments become a lien with 10% interest and late fees (max $15 or 10% of assessment). The association can foreclose. Any legal action by the association (except collections) needs 75% owner approval.
