Cashton Park South is a single-family home subdivision in Phoenix, AZ. These deed restrictions apply to all lots and govern what can be built, requiring a minimum house size, specific construction materials, and architectural review approval. The restrictions run with the land and are enforceable by property owners.
- Building & construction: Only one single-family dwelling per lot, minimum 1,200 square feet ground floor area (excluding open porches, carports, attached garages). Construction must be masonry, frame stucco, or finished frame. Each lot must have a septic tank and cesspool or approved sewerage; outdoor privies are permanently prohibited.
- Architectural review: A committee (initially three named individuals, later elected by owners after 75% of lots are sold) must approve in writing the design, location, and materials for any structure. If no committee exists or it fails to act within 30 days of a written request, approval is not required, but the building must still comply with all restrictions and be in harmony with existing structures in the vicinity.
- Duration & amendment: The restrictions run with the land until January 1, 1987, and automatically extend for successive 10-year periods unless a majority of the then-owners vote to change them in whole or in part.
- Enforcement: Violations may be restrained by court action, and damages may be awarded. However, a violation does not affect the lien of any recorded mortgage on the lot. If any restriction is held invalid, the others remain in effect.
