Casita Marie Townhouses is a townhome community in Phoenix, AZ — each owner holds fee simple title to a lot with a townhouse unit, and shares ownership of common areas through the Casita Marie Townhouse Corporation. The CC&Rs are binding on all owners, and cover shared responsibilities for party walls, exterior maintenance, and common area use.
- What you own & maintain: You own the interior of your townhouse (including fixtures and equipment inside exterior walls) and your individual patio. You are responsible for interior upkeep, termite control, and anything not maintained by the Association. The Association maintains the exterior (roofs, gutters, paint, trees, shrubs, walks) except glass surfaces.
- Assessments & fees: Annual assessments (initially max $300/lot/year, can increase up to 3% annually without a vote) and special assessments for capital improvements require a 2/3 vote of each membership class. Assessments are uniform per lot and may be collected monthly. Late payments bear 6% annual interest and create a lien on the property.
- Architectural review: No exterior structures, additions, or alterations may be built without prior written approval of the Board or an architectural committee. Plans must be submitted; if no decision within 30 days, approval is deemed granted.
- Party walls: Walls on lot dividing lines are party walls. If damaged by an owner or their guests, that owner must repair at their own cost. If damaged by other causes, adjoining owners share cost equally. Modifications to party walls require written consent of the adjoining owner.
- Use restrictions: Lots are for residential use only. No temporary structures or trailers are allowed as residences. Pets (dogs, cats) are allowed but not for commercial purposes. Signs are limited to one 'for sale' or 'for rent' sign of no more than 5 square feet. Business activities are prohibited. Clotheslines, garbage cans, and service yards must be screened.
- Common area & amenities: All owners have an easement to use common areas, subject to Association rules, fees for recreational facilities, and suspension of rights for nonpayment or rule violations. The Association may charge admission fees. Owners may delegate use to family, tenants, or contract purchasers.
- Damage & insurance: If an owner causes damage to common elements or their own townhouse, they must repair within 60 days (for townhouse) or promptly (for common elements). If they fail, the Association may repair and charge the owner, creating a lien. The lien is subordinate to first mortgages.
