What Cholla Estates Office Suites Condominium Association's governing documents say
Cholla Estates Office Suites is a commercial office condominium in Phoenix with seven office-suite units (A1–C2). Unit owners own their individual office spaces and share ownership of common building areas (hallways, parking, utilities), which the association maintains and funds through per-unit assessments allocated by square footage.
- What you own & maintain: You own your office suite from the exterior perimeter walls (or centerline of shared party walls) down to the floor slab and up to 12 feet above it. Utilities within your suite serving only you are yours; those serving multiple units are common elements maintained by the association.
- Party walls: Walls between adjacent units are jointly owned. Both owners share equally in all maintenance and repair costs—each pays 50%—unless one owner damages it through negligence or intent, in which case that owner pays the full cost. Modifications require written consent from the adjoining owner.
- Assessment allocation: Assessments are divided among units based on gross square footage. Your share is your unit's square footage (including a proportional share of any utility room in your building) divided by the total square footage of all units.
- Shared facilities: Each building has a utility room for the exclusive use of all units in that building. Parking spaces, driveways, sidewalks, and walkways are common-area amenities for all unit owners.
- Structural changes: Removing or modifying walls between adjacent units—including party walls—requires written board approval beforehand. The board will approve only if satisfied the change won't compromise the building's structural integrity or mechanical systems.
- Voting power: Your association voting power is proportional to your unit's square footage relative to all other units. The association's 100 total votes are distributed by this same percentage.
- Leasing your unit: If you lease your unit to a tenant, the tenant gains the right to use all common elements during the lease; you as owner cannot use them while the lease is active.
