Cinnabar is a condominium community in Phoenix, AZ — you own your individual unit and share ownership of common areas (including recreational areas) managed by the Cinnabar Condominium Association. This declaration governs the rights and obligations of unit owners regarding maintenance, assessments, use restrictions, and more.
- What you own & maintain: You own the interior of your unit (including garage/storage/patio), and the association maintains common elements like roofs, foundations, stairs, and recreational areas. Owners are responsible for maintaining interior surfaces and items like garage door openers, while the association maintains exterior walls, fences, and common utility lines.
- Pets: No more than 2 pets per unit (e.g., dogs, cats) allowed, and dogs/cats may not exceed 20 inches in height. Pets must be kept under control, and the board can require removal if behavior becomes objectionable.
- Leasing & rentals: Leases for less than 30 days or any rental with hotel-like services (maid, laundry, etc.) are prohibited. For longer leases, you must have a written lease that includes compliance with the declaration and association rules.
- Assessments & fees: All unit owners share equally in regular annual assessments (paid in 12 installments) and special assessments (subject to 51% membership vote). Assessments are due monthly or as set by the board, with interest at 10% per year on late payments; nonpayment can lead to lien foreclosure.
- Vehicle restrictions: No trailers, campers, commercial vehicles (except standard pickups), inoperative cars, boats, or similar equipment may be stored on the property except temporarily or in enclosed garages. Commercial vehicles used for business/personal use are allowed if signs are unobtrusive.
- Signs & external appearances: Signs advertising a unit for sale or rent may be placed only in board-designated locations. No other signs are allowed without board approval. Exterior clotheslines, window tinting, and storage on patios/balconies are prohibited, and window coverings require architectural approval.
- Use of units & conduct: Units are for single-family residential use only; no business or trade is allowed. Nuisances, activities that increase insurance rates, or that impair structural integrity are prohibited. Power equipment and major car maintenance require board approval.
- Architectural control: Alterations or improvements to units or common areas require prior approval from the Architectural Control Committee, including changes to window coverings or exterior modifications.
