What National Emblem North's governing documents say
National Emblem North is a single-family home subdivision in Phoenix, AZ, governed by recorded deed restrictions (a 'Declaration of Restrictions' from 1972). These restrictions apply to all lot owners and run with the land—they control what you can build, how you use your property, and what you can keep on it. There is no homeowners' association; instead, an Architectural Control Committee oversees construction plans.
- Use restriction: Lots may be used only for residential purposes. Only one detached single-family dwelling (max two stories) plus a private garage or carport (max two cars) is allowed. Mobile homes are prohibited, though travel trailers may be stored in the rear if properly screened.
- Minimum dwelling size: Any dwelling must have a ground floor area of at least 850 square feet, excluding open porches, pergolas, carports, and garages.
- Setbacks & fences: Front wall setback: minimum 20 feet from front property line. Side setbacks: at least 7 feet (10 feet if along a street). No solid fence or wall over 3.5 feet high within the front setback; side/rear fences no more than 6 feet. Hedges over 3 feet must be at least 2 feet from the front property line.
- Pets: No animals, livestock, or poultry may be raised, bred, or kept on any lot, except that dogs, cats, or other household pets are allowed as long as they are not kept, bred, or maintained for commercial purposes.
- Signs: No signs visible from public view except: developer signs during sales period, one professional sign of no more than 1 square foot, or one 'for sale' or 'for rent' sign of no more than 5 square feet.
- Architectural approval: No building may be erected, placed, or altered until plans and specifications are approved in writing by the Architectural Control Committee. Approval covers quality of workmanship, harmony of design, and location. If no decision within 30 days of proper submission, approval is deemed given.
- Duration & amendment: The restrictions run with the land until December 1, 2001, and automatically renew for successive 10-year periods. During the first 20 years, amendments require a recorded instrument signed by two-thirds of the lot owners and the Declarant.
- What this document doesn't cover: These restrictions do not establish a homeowners' association, levy assessments or fees, or regulate leasing (no minimum lease term). They are purely deed restrictions enforced by lot owners through legal action.
