National Emblem Park No. Two is a single-family home subdivision in Phoenix, AZ, governed by a Declaration of Restrictions recorded in 1971. These deed restrictions run with the land and bind all lot owners. The rules focus on residential use, building standards, and neighborhood aesthetics.
- Allowed use: Lots may be used only for residential purposes. Only one detached single-family dwelling (max two stories) plus a private garage or carport for up to two cars are permitted. Mobile homes are prohibited, but travel trailers may be stored on the rear portion of a lot if properly screened.
- Minimum dwelling size: No dwelling may have a ground floor area of less than 850 square feet, excluding open porches, pergolas, carports, and garages.
- Minimum setbacks: The front wall of any dwelling or garage must be at least 20 feet from the front property line. Side walls must be at least 7 feet from the side property line (10 feet if the side line is on a street). Detached garages located on the rear third of the lot have no side setback requirement.
- Architectural review: No building may be erected, placed, or altered until plans and specifications are approved by an Architectural Control Committee (initially Ronald S. Lushing, Gerald M. Lushing, and Dona H. Graves). Approval is based on quality of workmanship, harmony of design, and location. If the committee does not approve or disapprove within 30 days of submission, approval is not required.
- Pets: No animals, livestock, or poultry may be raised, bred, or kept for commercial purposes. Dogs, cats, or other household pets are allowed as long as they are not kept for commercial purposes.
- Fences & hedges: No solid wall or fence over 3.5 feet high may be placed closer to the front street than the front wall of the dwelling (or within 2 feet if no dwelling exists). Side/rear fences or walls may not exceed 6 feet in height. Hedges within 2 feet of the front property line cannot exceed 3 feet in height.
- Signs: No signs are allowed in public view except: (a) developer signs during sales, (b) one professional sign per lot no larger than 1 square foot, or (c) one sign per lot no larger than 5 square feet advertising the lot for sale or rent.
- Duration & modification: The restrictions run with the land until December 1, 2001, and automatically extend for successive 10-year periods. Before the end of any period, owners of a majority of the lots may modify the restrictions by signing and recording an instrument.
