What Colonia Montana's governing documents say
Colonia Montana is a condominium community in Phoenix, AZ — you own your individual unit and a 1/18 share of the common elements, which are maintained by the Colonia Montana Property Owners Association. This document is the governing declaration that sets out ownership rights, maintenance responsibilities, use restrictions, and the association's powers.
- What you own & maintain: You own the interior of your unit, including interior surfaces, fixtures, and appliances. The association maintains the common elements (pool, landscaping, parking, etc.) and exterior portions of buildings (foundations, exterior walls, roof over common areas, etc.). Party walls between units are jointly maintained.
- Assessments & fees: Each unit owner pays a uniform share (1/18) of common expenses, including taxes, insurance, maintenance, and reserves. Assessments are set by the board and can be monthly or periodic. Delinquent assessments accrue 10% annual interest and become a lien on the unit.
- Leasing & rentals: No rooms may be rented or transient guests accommodated, but rental of an entire unit is allowed. All leases require board approval, and the association has a right of first refusal to purchase the unit on the same terms.
- Occupancy & use: Each unit must be occupied by a single family as a residence only. No business, commercial, or institutional use is allowed. No noxious or offensive activities are permitted.
- Pets: The document does not mention pets; pet restrictions would be covered by association rules and regulations, not this declaration.
- Architectural review & alterations: Any alteration to portions maintained by the association (e.g., exterior walls, common elements) requires written approval from the board and all affected unit owners. Interior changes are the owner's responsibility but must not jeopardize safety or easements.
- Insurance & damage: The association carries master property and liability insurance on the buildings and common elements. Unit owners are responsible for insuring their own personal property and interior finishes. After damage, repairs are governed by the declaration and proceeds are held in trust.
- Sale & transfer restrictions: The association has a right of first refusal on any sale or lease of a unit. The board must be given notice and has 15 days to approve or exercise the option. If the board disapproves, it can buy the unit within 45 days.
