The Vista @ The Peak is a condominium community in Phoenix, AZ — you own a unit (office or medical space) and a share of the building's common elements. The association maintains the common areas and enforces rules. This is NOT a residential community: units may be used only for general office and/or medical purposes, not for housing.
- Use restrictions: Units may be used only for general office and/or medical purposes. No residential use, no housing or living purposes allowed. Any other use requires approval of the Declarant or all unit owners.
- Animals: No animals, reptiles, fish (except an aquarium inside a unit), or birds may be kept on any unit or common elements unless approved in writing by the Board.
- Leasing & rentals: Leases or rental agreements must be in writing, subject to all condominium documents, and a copy must be delivered to the Board before the term begins. Each lease must require the tenant to comply with the condominium documents.
- Parking & vehicles: There are 100 parking spaces total, with 40 covered spaces assigned as limited common elements for exclusive use of certain unit owners. Uncovered spaces are for common use. Vehicles must park only in designated spaces. No storage, abandoned, or infrequently used vehicles allowed without Board approval.
- Roof usage: Unit owners may use the roof non-exclusively Monday through Friday from 8:00 a.m. to 5:00 p.m. for lunch or work breaks. Items must be removed when not in use. No owner may derive revenue from roof use. Aunt Chilada's restaurant has additional rights for events as per a Reciprocal Easement Agreement.
- Business use restrictions: Prohibited businesses include automotive service/repair, heavy equipment sales/rental, motorcycle/snowmobile sales, recreational vehicle repair, pawn shops, landscaping retail, food preparation, fast food, and salons/barbers (unless allowed elsewhere). Other businesses not listed are subject to the general office/medical use restriction.
- Architectural review: Exterior changes, modifications, additions (such as painting, awnings, signs, landscaping) require prior written approval from the Board (acting as an Architectural Committee). Plans and specifications must be submitted; if not approved or disapproved within 30 days, approval is deemed given.
- Assessments & voting: The Board sets annual, special, and supplemental assessments to cover common expenses and reserves. Assessments are a lien on the unit and a personal obligation of the owner. Voting rights are based on unit square footage: 1 vote per 500 sq ft, with fractional adjustments. Owners must be current on assessments to vote.
