The amendment primarily governs the maintenance of a sign easement—specifically, landscaping, water, and electricity costs—between the homeowner association (Cordabella at CopperWynd HOA) and SunTech Development LLC. It also adds a requirement that future amendments require written approval of both the association and SunTech.
- Sign Easement Maintenance: The HOA is responsible for landscaping, water, and electricity for the sign easement area. SunTech must reimburse the HOA quarterly based on a formula using prior-year utility costs and landscaping contract percentages. The HOA must provide invoices by the 10th of January, April, July, and October.
- Cost Calculation & Billing: Each January, the HOA calculates monthly charges by averaging prior year's water/electric bills and using the current landscaping contract cost, each multiplied by the percentage attributable to the sign easement.
