What Coral Gables West's governing documents say
Coral Gables West is a single-family home subdivision annexed into the Coral Gables Estates HOA (planned area development). This document adds 19 lots and three tracts to the existing CC&Rs, binding new owners to the same covenants as Coral Gables Estates Units Two and Three. It is not a complete rulebook but a supplemental annexation document with specific additional rules for these lots.
- Type of community & document: This is a Declaration of Annexation for Coral Gables West, a section of single-family homes added to the existing Coral Gables Estates HOA. The full covenants are in the prior Declaration recorded in 1980, as amended.
- HOA assessments & fractional obligation: Each lot owner must pay an assessment of initially $60 per month (or the current rate for Units Two and Three) starting when construction begins. Each lot represents a 1/101 fractional share of HOA expenses until changed per the prior Declaration.
- Private sewer line maintenance: Owners of lots 1 through 19 are jointly responsible for maintaining, repairing, or replacing the private sewer line not covered by the city. A committee appointed by majority of these lots can oversee the work, and costs are a pro rata personal obligation and lien on the lot.
- Building restrictions: Lots 1-3, 6-10, and 13-19 are subject to city hillside development review. No structures or vegetation may block drainage easements or the Cave Creek wash floodway. Fencing and paving are allowed within utility easements only if removable.
- Utility & access easements: A blanket easement allows utilities (water, sewer, gas, electric, phone, TV antenna) on all lots and common areas. The declaration also grants vehicular access across private ways in the earlier phases (Units Two and Three) to Coral Gables West properties.
- Amendments & declarant powers: Declarant (Monterra Development) can amend this annexation for 4 years to meet VA, FHA, FNMA, etc. requirements. Other amendments follow the prior Declaration.
- What this document doesn't cover: This is an annexation supplement; it does not contain the full HOA rules (e.g., architectural control, pet restrictions, leasing rules, parking). Those are in the original Declaration (1980) and amendments referenced therein.
