Cortez Groves is a townhome community in Phoenix, AZ where you own your lot and home, share party walls with neighbors, and the association maintains common areas and exteriors. These governing documents establish a homeowners association (Cortez Groves Lot Owners Association) and apply to all lot owners.
- What you own & maintain: You own your lot and the townhouse on it. The association maintains common areas (Tracts A-D) and provides exterior maintenance for each lot including roofs, gutters, paint, trees, and shrubs, but not glass surfaces, patios, or damage caused by your negligence.
- Assessments & fees: Annual assessments start at a maximum of $264 per lot initially, can be increased by 2/3 vote of each membership class. Special assessments for capital improvements also require 2/3 approval. Assessments are a lien on the property and must be paid when due; delinquent assessments accrue 8% interest and may be foreclosed.
- Architectural review: No building, fence, wall, or exterior alteration may be made without written approval from the Board or an architectural committee. Plans are deemed approved if not acted upon within 30 days. The review considers harmony of external design and location.
- Use restrictions: Properties are restricted to residential use only. No business activities, no temporary structures, no trailers or tents. No livestock, poultry, or commercial breeding of pets. Dogs, cats, or household pets are allowed. Signs limited to one 5 sq ft 'for rent' or 'for sale' per lot. Clotheslines confined to patios; garbage and storage must be screened.
- Party walls: Walls on lot dividing lines are party walls. Repair and maintenance costs are shared proportionally by the owners who use the wall. Disputes are resolved by arbitration. Rights and obligations run with the land.
- Membership & voting: Each lot owner is a member with one vote per lot. Initially, the Declarant holds a Class B membership with three votes per lot, converting to Class A when Class A votes equal Class B votes or by June 1, 1973. Meetings require a quorum of 1/10 of each class, except for assessment increases which require 60%.
- Common area use: Owners and their tenants, family, or contract purchasers have an easement to use common areas. Use may be suspended for unpaid assessments or rule violations (max 60 days). The association can charge fees for recreational facilities after five years, subject to 2/3 vote.
- Enforcement & amendments: The association or any owner may enforce the covenants. Amendments during the first 20 years require 90% of lot owners; thereafter, 75%. Additional property may be annexed with 2/3 vote of each class. The document runs with the land for 20 years, auto-renewing for 10-year periods.
