This is a Tract Declaration for Cypress Point at Ocotillo, a single-family residential parcel within the larger Ocotillo master-planned community in Phoenix, AZ. It supplements the master declaration with parcel-specific rules on land use, development, and easements. It applies to current and future owners of lots within the parcel.
- Land use classification: The parcel must be used solely for single-family residential use as authorized by the master declaration.
- Building permit & development approval: No building permit may be applied for, and no construction may begin, until the declarant (developer) has approved in writing the proposed uses, development plan, improvements, density, plans and specifications, landscaping (through the Association and Design Review Board), and any required easements.
- Subdivision limits: The parcel cannot be further subdivided or conveyed in parts unless permitted by law and approved in writing by the declarant and the Association. Upon recordation of a final plat, obligations and liabilities apply proportionally to each lot.
- Effluent obligation: Declarant does not require effluent use on residential lots but acknowledges effluent will be used for common area landscaping (Tracts A, B, C) maintained by the Association. This overrides the master declaration's Article VII, Section 6.
- Inundation easement: An inundation easement is created over all portions of the parcel below 1,190 feet above mean sea level. Owners accept liability for damage from constructing improvements below that elevation and indemnify the declarant and Association.
- Association membership & assessments: The parcel initially has 93 memberships in the Association for assessment purposes. Upon recordation of a subdivision plat, the number will be adjusted per the master declaration. Common areas must be maintained by the owner unless the Association undertakes maintenance.
- Modification & enforcement: Declarant may amend this Tract Declaration for non-material changes, site plan approval, or membership adjustments. Other amendments require following the master declaration's Article XIII. Declarant and Association may enforce the document; enforcement costs are passed to the breaching owner as special assessments.
