What Bailey Commons Condominium's governing documents say
Bailey Commons Condominium is a residential condominium community in Phoenix, AZ. You own your individual unit and share an undivided 1/24th interest in the common elements with other unit owners. The condominium is governed by this Declaration, which runs with the land and binds all owners, lessees, and occupants.
- Use & home business: All units must be used for residential purposes only. A home business is permitted if it is not visible or detectable from outside the unit, conforms to zoning, involves no customer visits, and does not create a nuisance.
- Pets: Up to 2 dogs and 2 cats per unit are allowed as household pets. Dogs must be leashed on common elements and owners must clean up waste. The board may restrict breeds deemed dangerous and require removal of pets that are a nuisance or threat.
- Architectural review: Any exterior construction or modification must receive prior written approval from the Design Review Committee. The committee may deny based on aesthetic considerations, and approval is not a warranty of code compliance.
- Parking & vehicles: No recreational vehicles, boats, or trailers may be parked on common elements or visible from neighboring property. Commercial vehicles over 8 feet tall or 24 feet long are not allowed except for temporary parking of contractor vehicles (max 72 hours).
- Assessments & voting: Common expenses are shared equally among all 24 units. Each unit has one vote in the association. The board may levy regular, special, and enforcement assessments. Nonpayment can result in a lien.
- Dispute resolution: Disputes under the declaration are subject to a multi-step process: notice, mediation, and binding arbitration. The Federal Arbitration Act applies. Certain disputes may be resolved without litigation.
- What this document doesn't cover: The OCR excerpt is incomplete; specific leasing restrictions (e.g., minimum lease term) and exact assessment amounts are not fully readable from this text. For complete details, refer to the full recorded Declaration.
