Deer Valley Business Center is a commercial condominium in Phoenix, AZ — you own an individual office unit and share ownership of common elements (parking, landscaping, etc.) maintained by the Deer Valley Business Center Owners Association. This declaration governs all unit owners and occupants, and is established under Arizona's condominium act. The community is strictly for office use; no residential or living purposes are allowed.
- Permitted use: Units may only be used for office purposes. No portion may be used for housing or living purposes. All uses must comply with applicable zoning laws and the specific business uses listed in Exhibit E of the declaration.
- Animals: No animals, reptiles, fish (except an aquarium inside a unit), or birds may be raised, bred, or kept on the property without prior written approval of the Board.
- Leasing & rentals: Any lease or rental agreement must be in writing, must comply with the condominium documents, and must include a clause that the tenant is bound by those documents. A copy of the lease must be delivered to the Board before the term begins.
- Parking & vehicles: All vehicles must be parked only in designated parking spaces. Initial parking assignments are set forth in Exhibit C; the Board or Declarant may reassign spaces. No storage of vehicles (e.g., trailers, boats, RVs) is permitted without Board approval.
- Architectural review: No exterior changes, additions, or alterations (including painting, landscaping, signs, awnings, fences, or structural changes) may be made without prior written approval of the Board acting as the Architectural Control Committee. Plans must be submitted; if not approved or disapproved within 30 days, approval is deemed given.
- Assessments & fees: Each unit pays annual, special, and supplemental assessments based on its allocated common expense liability percentage (ranging from 3.30% to 3.79% per unit). Assessments are due as set by the Board; delinquent payments incur 15% annual interest and may result in a lien on the unit. A two-month working capital fund is required from purchasers from the Declarant.
- Insurance: The Association must maintain master casualty insurance covering the common elements (100% replacement cost) and public liability insurance (minimum $1 million per occurrence). Each unit owner should obtain their own insurance for their unit and personal property.
