Del San Estates is a standard single-family residential subdivision in Phoenix, AZ, governed by recorded deed restrictions (CC&Rs) — not an HOA with dues or common areas. These covenants run with the land and bind all lot owners, requiring detached single-family homes with minimum sizes, setbacks, and usage limits.
- Single-family use only: All lots are restricted to one detached single-family dwelling per lot, plus a private garage for up to two cars. No hospitals, sanitariums, hotels, boarding houses, lodging houses, or apartments of any kind are permitted.
- Minimum house size: The ground floor area (excluding open porches, pergolas, and attached garages) must be at least 950 square feet for a two-bedroom home and at least 1,150 square feet for a three-bedroom home.
- Setbacks & fence limits: Houses must be set back 20–40 feet from the front property line, at least 5 feet from side lot lines (2 feet for attached carports in rear one-third), and 10 feet from side street lines. Fences or solid walls can't be more than 2½ feet high nearer the front than the house's front wall (or within 20 feet of the front lot line if no house exists). Side and rear fences/walls cannot exceed 6½ feet. Hedges over 4½ feet are banned within 20 feet of the front lot line.
- Animals: No chickens or other fowl may be kept or harbored on any lot.
- Signs & nuisances: Only 'For Rent' or 'For Sale' signs not over 15x25 inches are allowed. No advertising signs, billboards, unsightly objects, or nuisances that endanger health or disturb neighbors are permitted.
- Duration & renewal: These restrictions were set to automatically run until January 2, 1995, and then renew for successive 10-year periods unless a majority of property owners vote to change them.
