What Desert Dawn Estates's governing documents say
Desert Dawn Estates is a single-family home subdivision in Phoenix, AZ. This document is a 1973 amendment to the original Declaration of Restrictions, adding assessment rules for the homeowners association. It does not contain the full set of HOA rules — only the financial obligation for common area costs.
- Assessment obligation: Each lot owner must pay a prorata share of the association's actual costs for maintaining and improving common areas, plus a reserve fund. The annual assessment is set by the Board of Directors and payable either in full by January 15 or in 12 monthly installments due on the 10th of each month.
- Late payment & liens: If a monthly installment is not paid by the last day of the month it becomes due, the unpaid amount becomes a lien on the lot, enforceable by foreclosure like a mortgage.
- Future subdivisions: Owners of lots in adjacent future subdivisions may become members of this HOA, and their lots would be subject to the same prorata assessments.
- What this document doesn't cover: This amendment does not address architectural rules, pet restrictions, leasing limits, parking, or other typical HOA covenants. Those may exist in the original Declaration of Restrictions (not provided here).
