Desert Sunrise Vistas is a standard single-family home subdivision in Phoenix, AZ. The CC&Rs run with the land and bind all owners, protecting property values through use restrictions and maintenance obligations.
- Lot use & construction: Lots are for single-family residential use only. Each dwelling must be at least 2,450 sq ft of livable area, on a permanent foundation, and must be completed within 12 months. No mobile, manufactured, prefabricated, modular, or multi-sectional housing is allowed. Maximum building height is 22 feet.
- Design & appearance standards: All buildings, fences, and structures must use natural desert tones. Chain-link fencing is prohibited. All improvements must be new construction and remain in good repair. No repairs of detached machinery or vehicles may be done in view of other lots or streets unless completed within 10 days.
- Parking & vehicles: Motor vehicles owned or in custody of an owner may only be parked on that owner's lot. Street parking is allowed only for approved deliveries, pickups, or short-term guests, and must not interfere with road use. Inoperable, unlicensed, abandoned, or heavy equipment vehicles must be stored in a covered, screened structure.
- Animals: An owner may keep up to 3 horses and a reasonable number of other domestic animals. Cows are prohibited. All animals must be properly enclosed (pen, cage, fence, corral) within the lot or on a leash (except domestic cats). Manure must be regularly removed, and no animal may become a nuisance.
- Storage & outdoor maintenance: No exterior storage is permitted unless attractively screened from view. This applies to trash, construction materials, firewood, and inoperable vehicles. Landscaping and recreational equipment may be stored in regular use. Garbage must be in covered containers and regularly removed.
- Enforcement & amendment: The Declaration runs for 40 years from recording, then automatically extends for successive 10-year periods. Amendments require 100% of lot owners' approval. Any owner may enforce the covenants, and the prevailing party in enforcement actions is entitled to costs and attorney's fees.
