Desierto Vida is a single-family home subdivision in Phoenix, AZ, governed by a homeowners' association (HOA). The HOA maintains common areas (perimeter wall, entry gates, mailboxes) and enforces rules through assessments and an architectural committee.
- Use restrictions: Each lot is for single-family residential use only. No more than one living unit per lot. Businesses, religious, institutional, or commercial uses are prohibited, except for one garage/yard sale per year per owner.
- Architectural review: All structures, fences, walls, landscaping, and exterior changes must be pre-approved in writing by the Architectural and Landscaping Control Committee. Plans must show design, colors, materials, and location.
- Assessments: Annual assessments start at a maximum of $900 per lot. They can increase each year by the greater of CPI or 15% without a membership vote. Further increases require a two-thirds vote of Class A members. Semi-annual payments due January and July. Past-due amounts bear 12% interest (or prime + 3%).
- Leasing & rentals: Only entire living units may be rented, and only for residential use (no transient/hotel). Leases must be in writing, subject to the governing documents, and the owner must notify the HOA of lease start/end dates and occupant names.
- Pets: Only common household pets (no livestock, poultry) are allowed, not for commercial breeding. They must be kept indoors or in fenced yards, not run loose, and not cause annoyance. Pet structures must not be visible from neighboring property.
- Parking & vehicles: No mobile homes, boats, RVs, campers, trucks over 3/4 ton, or commercial vehicles may be kept on lots or streets. Overnight parking on streets or in driveways is prohibited, except one guest vehicle in the driveway for up to 7 consecutive days. Vehicles should be garaged if possible.
- Maintenance & upkeep: Owners must maintain their living unit's exterior (walls, roof, porches) and keep landscaping trimmed and free of weeds. Garages must be kept neat and garage doors closed except for ingress/egress. Trash must be in covered containers not visible from neighbors except on collection days.
- Party walls: Walls built on lot dividing lines are party walls. Construction and repair costs are shared equally by adjoining owners. Disputes go to arbitration.
