Discovery at Villa de Paz is a condominium community (horizontal property regime) in Phoenix, AZ. You own your individual unit (apartment) and an undivided share of the common elements. The association (Discovery at Villa de Paz Homeowners’ Association) is responsible for maintaining common areas and administering the community. All unit owners automatically become members and must follow this Declaration, the Articles, Bylaws, and Rules and Regulations.
- What you own & maintain: You own the interior airspace of your apartment, including interior surfaces, and certain fixtures like ranges, dishwashers, and fireplaces. The association maintains common elements (e.g., recreational facilities, parking areas, landscaping). Some areas like patios, balconies, and storage lockers are limited common elements for your exclusive use, but you must maintain them; the association may step in and charge you if you fail.
- Assessments & fees: Each unit pays a proportionate share (1/total number of units) of common expenses. The maximum annual regular assessment initially is $65.46 per unit. After the first unit is sold, it can increase by the greater of CPI or 5% per year without a membership vote; any larger increase requires approval of two-thirds of each class of members. Special assessments also require a two-thirds vote. Assessments are due monthly by the 10th; late payments accrue 12% interest per year.

The developer (Declarant) holds Class B membership with three votes per unit owned until March 31, 1989, or when Class B votes equal Class A votes, whichever comes first. The board may limit guests, charge reasonable fees for recreational facilities, and suspend use rights for delinquent owners. The developer can annex additional phases within seven years of the declaration without owner consent, provided the annexation is consistent in type and quality. The common element interest per unit adjusts as more units are added (1/total units).

Directors must be owners (or their spouses or representatives) unless the developer controls. The board adopts rules and regulations, sets assessments, and maintains financial records.
