Doublegate is a 14-unit condominium in Carefree, Arizona, where you own your individual unit interior and share ownership of common elements maintained by the association. The governing rules (original 1981 with amendments through 2001) impose strict restrictions: no residents under age 18, no pets of any kind, maximum three rental units, and limited exterior modifications.
- What you own & maintain: You own your individual unit interior; the association maintains and insures the building structure, common areas (pools, landscaping, sidewalks, utilities), and outside walls/roofs. Each unit holds a 1/14th fractional ownership share in the entire regime.
- Age restriction (no children): No residents under age 18 are permitted, with grandfather exceptions only for children already living in units as of the 1987 amendment. This is a blanket ban, not merely a limit on rentals to families with children.
- Pets: No pets of any kind are allowed. Only animals already in units before the 1987 amendment are grandfathered and cannot be replaced.
- Leasing & rentals: Maximum of three units may be rented at any time. Lease applications require board approval, which is granted only if fewer than three units are currently leased. Seven specific units (1, 2, 3, 6, 7, 8, 14) were grandfathered as rental units.
- Vehicles & parking: Maximum of two vehicles may be parked outside the garage. Motorhomes, boats, campers, commercial trucks, and busses are prohibited except for temporary loading and unloading.
- Exterior modifications & architectural control: Any exterior alteration, landscaping beyond enclosed patios, signs, awnings, or grillwork requires prior written board consent. Board can enter to remove violations and perform repairs at the owner's cost and lien.
- Right of first refusal on sales & leases: Before selling, renting, or leasing your unit, you must notify the board with full terms and the prospective party's information. The board has ten days to consent or name an alternate buyer/tenant on the same terms; silence is deemed consent. Foreclosure purchasers from financial institutions are exempt.
- Assessments, fees & delinquency: Each owner pays a pro-rata share (1/14th) of operating costs, payable in quarterly installments due January 1, April 1, July 1, and October 1. Delinquent payments incur $4/day penalties and become a lien; the association can foreclose and exclude delinquent owners from common facilities.
