El Matador Condominiums No. 1 is a small condominium community in Scottsdale, AZ, consisting of six units in two three-unit buildings. You own your individual unit and an undivided 1/6 interest in the common areas. The community is governed by this Declaration and the Association's By-Laws.
- What you own & maintain: You own the interior surfaces (plaster, paint, etc.) of your unit. You do not own the perimeter walls, floors, ceilings, or pipes/wires that serve more than one unit. You are responsible for all maintenance and repairs inside your unit, including water, light, gas, power, sewage, telephone, air conditioners, doors, windows, lamps, and other accessories.
- Leasing & rentals: Rentals for less than 30 days or rentals that include hotel-like services (room service, maid, linen, bellboy) are prohibited. Owners have the right to lease, provided the lease complies with the Declaration and By-Laws.
- Pets: The Board of Directors determines whether domestic animals may be kept in the condominiums. There is no guaranteed pet allowance; it is subject to Board approval.
- Assessments & fees: Monthly assessments are levied equally among all six units. They cover common expenses including utilities for common areas, water for each unit, insurance, operating reserve, and replacement reserve. Assessments are due on the 1st of the month, delinquent after 10 days, and are subject to late penalties, interest at 10% per year, and attorney's fees for collection.
- Use restrictions: Units may be used only as private dwellings for the owner, family, tenants, and social guests. No commercial use. No posting advertisements, making excessive noise, hanging garments from windows, shaking rugs from windows, throwing garbage improperly, or washing vehicles on carports or common areas. No structural modifications without prior written notice to the Association (15-day response period).
- Parking & vehicles: Parking is allowed only in prescribed areas. Washing automobiles, bicycles, boats, or motorcycles on carports or common areas is prohibited.
- Common area ownership & easements: Common areas are owned as tenants in common by all unit owners. They cannot be partitioned. An easement exists for utilities over the common areas. Restricted common areas (specific parking/storage) are allocated to each unit.
