Las Villas Del Rey Condominiums is a residential condominium community in Phoenix, Arizona, where you own your individual unit but share ownership of the building's common elements through a mandatory homeowners association. The association is governed by a board of directors and maintains the structure and grounds; you maintain your unit's interior.
- What you own & maintain: You own your unit's interior, including all finishes (flooring, walls, paint), interior doors, window and door glass, and individual appliances (stove, refrigerator, AC, heating, hot water heater, lighting fixtures, plumbing fixtures). You must keep your garage, patio or balcony, and storage spaces clean and attractive. Structural components, shared utility lines, and building exterior remain the association's responsibility.
- What the association maintains & funds: The association maintains all common elements—the building structure, grounds, shared utilities, recreational facilities, landscaping, and pool service—funded by your regular assessments. If you damage common elements through misuse, repair costs are added to your assessment bill.
- Regular monthly assessments & fee increases: Regular assessments start at a maximum of $100 per month per unit. After the first fiscal year following your purchase, the board may increase assessments annually by whichever is greater: 5% or the Consumer Price Index. Increases beyond that require a two-thirds vote of all owners. Capital improvement assessments (for major repairs/replacements) also require a two-thirds owner vote and are held in a separate account.
- Mandatory golf club membership: All unit owners must maintain membership in Rancho Del Rey Golf and Country Club. An annual membership assessment (up to $250 per unit, set by the club) is collected by the association along with your regular assessment and paid to the club. The club membership is uniform across all units.
- Utilities & utility costs: Each unit has separately metered utilities (water, gas, electricity). You are responsible for paying your own utility bills directly to the service providers; these are not part of the association assessment.
- Architectural review & modifications: No exterior modifications, additions, or structures—including fences, walls, antennas, towers, awnings, patio enclosures, or temporary structures—can be erected or altered without the board's prior written approval. The board reviews plans and specifications to ensure harmony with the community's external design and surrounding properties.
- Governance & voting: The community is governed by a 3–7-member board elected by owners. Each owner receives one vote per unit. The developer initially has 3 votes per unit (Class B membership) but this converts to standard Class A membership (1 vote per unit) after three years or when other owners' total votes equal the developer's, and permanently after five years from the first sale.
- Delinquency & enforcement: Assessments not paid within 10 days incur a 5% late fee. If unpaid after 30 days, 12% annual interest is charged. The association can foreclose on your unit for unpaid assessments. Delinquent owners lose voting rights and access to recreational facilities until assessments are paid in full.
