Initial authority rests with the developer; the Estrella Joint Committee assumes oversight after the development period ends.
- What you own & maintain: You own your parcel and are solely responsible for maintaining all structures, landscaping, and improvements in a safe, clean, neat, attractive condition consistent with community standards. If structures are damaged or destroyed, you must either repair or reconstruct them diligently, or clear the parcel and maintain it as landscaped open space.
- Architectural & design review: All exterior site work, landscaping, structures, and improvements visible from outside require prior written approval. The Reviewer (Declarant initially, then Joint Committee) has 30 days to respond; if they don't respond, approval is automatically granted. Approval is based on Design Standards and community aesthetic standards.
- Permitted & prohibited uses: Your parcel must be used for non-residential commercial purposes consistent with the master plan. Completely prohibited uses include trailer/RV parks, junkyards, oil/gas drilling, truck-stop facilities, adult entertainment venues, tattoo/piercing shops, and retail of used/secondhand goods. Any change in use requires Reviewer approval.
- Restricted activities: Many activities require approval or are prohibited: burning, outdoor storage of materials (except incidental to permitted business), digging wells, installing irrigation, posting signs, and parking commercial trucks overnight or weekends. Activities creating nuisances—loud noise, foul odors, flashing lights—are also restricted.
- Governance & enforcement: The developer initially has exclusive authority; the Estrella Joint Committee takes over after the development period ends. Violations are subject to enforcement; violators must receive written notice and a reasonable opportunity to cure before the authority can enter the property to remedy violations.
- Easements & access rights: Declarant and Joint Committee reserve easements for utilities, drainage, stormwater, pedestrian access within 20 feet of parcel boundaries, and emergency/enforcement entry. Utility providers have the right to access, install, maintain, and inspect utilities within these easement areas.
- Hazardous materials responsibility: You are obligated to indemnify (legally protect from liability) Declarant, the Joint Committee, other parcel owners, and all occupants for any damages or claims arising from hazardous materials on your parcel—including generation, storage, disposal, or release.
