This is a master-level Declaration of Easements, Covenants, Conditions and Restrictions (CC&Rs) for the Centerra City Center planned community in Goodyear, AZ. It applies to two large parcels: a Commercial Parcel and a Residential Parcel (planned for condominium or multifamily development). The rules here govern the relationship between the owners of those two parcels, not individual homeowners or condo unit owners. If you are looking to buy a home in the residential section, the specific condo or HOA rules for your unit will be in a separate document.
- Property type & parcel split: The community consists of a Commercial Parcel (Lot 2) and a Residential Parcel (Lot 1). The Residential Parcel is intended for multifamily residential and/or condominium use; the Commercial Parcel is for commercial uses permitted by zoning, with up to 6 residential lofts allowed.
- Use restrictions (commercial): The Commercial Parcel cannot be used for massage parlors (except as part of a spa), halfway houses, dialysis clinics, abortion clinics, dance halls, adult entertainment, pawn shops, flea markets, junk yards, churches, mortuaries, day labor facilities, commercial animal boarding (except overnight boarding incidental to a vet or pet store), or residential purposes (except for the 6 allowed lofts).
- General property rules: No hazardous activities, open fires, or firearms on the property. No mining or drilling. Landscaping must be kept neat. Parking areas must be paved. No outdoor speakers/amplifiers causing nuisance. No mining or drilling.
- Shared easements & access: There are non-exclusive easements for pedestrian and vehicular ingress/egress over certain driveways and parking areas, and specific access easements from Goodyear Boulevard and Estrella Parkway. The Commercial Parcel must also accommodate drainage from the Residential Parcel via a retention basin.
- Maintenance responsibilities: Each parcel owner must keep all improvements and landscaping on their parcel in good, clean condition, promptly repair damage, remove graffiti, and remove trash. If improvements are damaged, the owner must repair or demolish within a reasonable time.
- Insurance requirements: Each parcel owner must maintain commercial general liability insurance in a commercially reasonable amount, or may self-insure if net worth is at least $50 million (or if a publicly traded company). Proof of insurance must be provided upon annual request.
- Enforcement & signing rights: Only the parcel owners (not individual unit owners) can enforce these restrictions. The Administrative Agent (initially the developer, then possibly the association) handles duties. Signage on the property must comply with Community Standards and applicable laws.
- What this document doesn’t cover: This document does not contain specific condo rules (e.g., pet limits, lease terms, assessments). Those will be in a separate condominium declaration or HOA governing documents for the Residential Parcel.
