What Centerra Village Court's governing documents say
Centerra Village Court is a single-family home subdivision within the larger Centerra master-planned community in Goodyear, AZ. This document is an additional declaration that creates a subassociation (Centerra Village Court HOA) and imposes extra rules beyond the master community's governing documents. It binds all homeowners, residents, and tenants.
- Parking & vehicles: Parking on private drives is prohibited except for emergency vehicles. On private streets, vehicles may park only in marked areas and for no more than 24 hours. Vehicles include cars, trucks, RVs, boats, and trailers.
- Landscaping & maintenance: Owners must install landscaping (grass, trees, irrigation) within 180 days of purchasing the lot and must keep it trimmed, watered, and free of weeds. The subassociation maintains private streets and private drives, and may use treated effluent for irrigation.
- Prohibited items: No basketball goals, backboards, or similar structures are allowed on any lot. Rooftop HVAC equipment is prohibited. No above-ground fuel tanks; only buried underground tanks are permitted.
- Use and benefit easements: Some lots have 'Use and Benefit Easements' over adjacent lots' side yards for drainage and maintenance of shared walls. The benefited lot owner can use the easement area but cannot place hardscape, discharge water, or store combustible materials there.
- Assessments & fees: Annual assessments are levied equally on all lots. For 2007, the maximum annual assessment is $1,080 per lot, adjusted annually by the greater of CPI or 10%, with possible increases for insurance or utilities. Special assessments require a 2/3 vote of members. A transfer fee may be charged to new owners.
- Subassociation governance: The subassociation (Centerra Village Court HOA) is governed by a board, initially appointed by the declarant (builder) until a transition period ends. Owners have one vote per lot. The board can adopt rules and enter into bulk service agreements (e.g., cable, internet, trash).
- What this document doesn't cover: This is an additional declaration; it supplements the master community's rules. It does not cover leasing restrictions, pet limits, age restrictions, or architectural review procedures—those may be in the master declaration or other documents.
