This is a First Amendment to the Declaration of Condominium for Foothills Paseo III, a condominium in Phoenix, AZ. It is an ancillary document that modifies the original declaration, primarily to add future annexable property in phases and to clarify a unit owner's right to make certain interior modifications without approval. - What this document is: This is an amendment, not the full rulebook. It supplements the original Declaration of Condominium recorded January 7, 2005. Residents must also consult the original declaration for all governing rules.
- Phased development & future annexation: The developer, D.R. Horton, conditionally adds 80 units (phased as 40 duplex unit groups) to the condominium. Each phase becomes irrevocably part of the condominium when the first unit in that phase is sold to a buyer or when the developer records a confirmatory declaration, whichever comes first. The developer may withdraw unadded phases within 10 years.
- Allocation of common elements & voting: Upon the effective date for each added phase, each unit's undivided interest in the common elements and common expenses is recalculated equally among all units then subject to the declaration. Each unit receives one vote in the association.
- Interior modifications: Unit owners may, without needing association approval, attach finished surfaces, shelving, cabinets, lighting fixtures, and garage door openers to interior surfaces (ceiling, side walls, floor) of their designated space, and may apply standard garage epoxy to the garage floor.
