This is a commercial office and retail park in Chandler, AZ — not a residential community. The Declaration of Covenants, Conditions and Restrictions and Grant of Easements (CCRs) binds the owners of commercial lots within Foothills Corporate Park, governing how the property can be used, maintained, and developed. It is ancillary to a Master Declaration for the larger Foothills Gateway Centre.
- Permitted use & use restrictions: Lots may only be used as a unified commercial office and retail complex. Prohibited uses include skating rinks, bowling alleys, bingo parlors, movie theaters, mortuaries, and auto sales/repair (with limited exceptions for minor automotive repairs at a specified parcel). Outdoor storage is banned except in screened refuse areas.
- Maintenance obligations: Each owner must maintain their own lot, including all improvements, driveways, parking, landscaping, and off-site landscape areas. Common improvements (Monumental Driveway, storm water facilities, common signs, common landscaping) are maintained by a Manager funded by owner assessments. Failure to maintain gives the Manager or other owners the right to enter, perform work, and charge the non-complying owner.
- Architectural review & design guidelines: All new construction and material exterior alterations require prior written approval. For initial construction, approval must come from Declarant (while it owns a lot) and thereafter from owners of at least 75% of lots. Plans must comply with attached Design Guidelines covering site standards, building elevations, colors, landscaping, and hardscape. Temporary structures are prohibited except during construction.
- Assessments & fees: Each lot pays annual assessments based on its land area (excluding monument drive and retention basin). Assessments cover common improvement maintenance, manager compensation, and reserves. Annual budgets exceeding 115% of prior year require 75% owner approval. Special assessments for capital repairs exceeding 20% of budget also require 75% approval. Delinquent assessments bear interest at prime plus 6% and become a lien on the lot.
- Enforcement & liens: Violations can be enjoined by the Manager or any owner. Monetary defaults must be cured within 10 days of written notice; non-monetary defaults within 30 days (or longer if diligently pursued). Unpaid assessments become liens on the lot and can be foreclosed like mortgages. The prevailing party in enforcement actions is entitled to attorneys' fees.
