What Fry's Dobson Village's governing documents say
This is a commercial shopping center declaration for Fry's Dobson Village in Chandler, AZ, not a residential community. It governs a retail center anchored by Fry's supermarket and includes reciprocal easements, use restrictions, and common area maintenance obligations among commercial property owners. The shopping center is part of the larger Andersen Springs master-planned community, to which this declaration defers for certain master covenants.
- Property type & who rules bind: This document applies to commercial property owners (and their tenants) within the Fry's Dobson Village shopping center. It is not a residential HOA; it regulates a retail and commercial development.
- Permitted uses & exclusive rights: The shopping center is limited to commercial uses. Fry's has the exclusive right to operate a supermarket, drugstore, and pharmacy. No other building may sell groceries, meats, drugs, or operate a convenience store over 2,000 sq ft. Package liquor sales for off-premises consumption are prohibited except by small specialty shops.
- Prohibited uses: Certain uses are banned: sit-down restaurants (in specific areas near the Fry's building exceeding 24 seats), theaters (while Fry's exclusive is in effect), certain office types within 200 feet of Fry's, health spas/gyms over 1,300 sq ft, and any bar, tavern, cocktail lounge, or adult entertainment venues.
- Common area maintenance & costs: The party maintaining the common areas (initially Developer) operates and maintains parking, landscaping, utilities, etc. Owners (except exempt owners) pay a pro rata share of Common Area Maintenance Costs based on their building's gross floor area. Exempt owners maintain their own parcels at their own expense.
- Building & design restrictions: Buildings must be first-class construction and conform to a uniform general plan. Height is limited to one story (or per Exhibit I). Allowed gross floor area per building is set in Exhibit C. Alterations need plan approval unless they don't substantially change appearance.
- Parking & deliveries: Employee parking is restricted to designated areas (Exhibit K). A maneuvering area behind the Fry's building is reserved for Fry's delivery trucks; no obstruction allowed.
- Relation to master community: The shopping center is subject to the Andersen Springs Master Declaration and Tract Declaration. Owners must comply with those master covenants, which are not detailed here. This declaration does not cover residential rules.
- What this document doesn't cover: This document does not contain any residential occupancy rules, age restrictions, pet policies, lease minimums, or resident conduct rules. It only governs commercial operation of a shopping center. For residential aspects, refer to the Andersen Springs master declaration.
