What Glenaire's governing documents say
Glenaire is a single-family-home subdivision in Phoenix, AZ, governed by deed restrictions (CC&Rs) recorded by the original developer. These covenants run with the land and are enforced by lot owners, not by a homeowners' association — there is no HOA or mandatory assessments. The rules apply to anyone who owns a lot in Glenaire Unit I (lots 1–77) and Unit II (lots 155–210).
- Land use & buildings: Lots are for residential use only. Only one detached single-family dwelling (max 2.5 stories) and a private garage (max 3 cars) are allowed per lot. No trailers, tents, or outbuildings may be used as residences.
- Architectural review: Before construction or alterations, plans must be approved by a designated Architectural Control Committee (members listed in the documents). If the committee does not respond within 30 days of submission, approval is deemed given. The committee has no power to charge fees.
- Minimum dwelling size: No home may have less than 1,000 square feet of floor area, excluding open porches, patios, and garages. Lots must be at least 60 feet wide at the building setback line and have a minimum area of 6,000 square feet.
- Setbacks and height: Buildings must be set back at least 20 feet from front and side street lines (garages may be 3 feet from side line). Rear setbacks: 15 feet for interior lots. Eaves, steps, and open porches do not count as part of the building but cannot encroach on neighboring lots.
- Fences & landscaping: Between the street and front setback line, fences, walls, and hedges may not exceed 3 feet in height. Elsewhere on the lot, they may be up to 6 feet. All structures visible from the street must be completely enclosed on that side, and doors on that side must remain closed.
- Vehicles & parking: No trucks, trailers, boats, or unlicensed motor vehicles may be kept or parked between the street and the front setback line, except inside a fully enclosed carport or garage.
- Pets: No animals, livestock, or poultry may be raised or kept on a lot, except for dogs, cats, or other household pets — not bred or maintained for commercial purposes. No more than 4 total cats or dogs may be kept at any one time.
- Duration of covenants: These restrictions run for 35 years from the original recording date (1972 for Unit I, 1973 for Unit II), and automatically renew for successive 10-year periods unless a majority of lot owners record an instrument to change them.
