Goldwater Lakes is a single-family home HOA in Phoenix, AZ — you own your lot and house, while the Goldwater Lakes Owners Association owns and maintains shared common areas (parks, streets, lighting, etc.) funded by assessments on all lots. This document is the full set of rules binding all owners, residents, and their guests.
- What you own & maintain: You own your lot and house; you must maintain the exterior and landscaping. The Association maintains the common area (tracts A–R, about 9.15 acres) including streets, parking, walkways, lighting, and landscaping outside your lot.
- Assessments & fees: Regular annual assessments are set by the Board, initially capped at $65,280 total, with annual increases up to 5% without owner vote. Special assessments for capital improvements require 2/3 Board vote. Late payments accrue 8% interest and become a lien on the property. A separate master assessment for Lake Biltmore Village common area is apportioned among lots (lake-front lots weighted 3x, others 1x).
- Architectural review: Any exterior improvement (building, fence, wall, landscaping, repainting) requires prior written approval from the Design Review Team (3–9 members). Plans must be submitted; if not approved/disapproved within 60 days, approval is deemed granted.
- Use restrictions: Lots are for single-family detached dwellings only (minimum 1,200 sq ft for 2-bed, 1,400 for 3-bed, 1,650 for 4-bed; max 30 ft height). No temporary structures, trailers, tents, or outbuildings. No commercial animals; household pets allowed but cannot be a nuisance. No signs except one 9x30 inch name/address sign or a 5 sq ft for-sale/rent sign (with Design Review approval). Utility lines must be underground. Antennas visible from streets need Board approval. No trucks, buses, boats, campers unless screened. Lots cannot be subdivided.
- Leasing & rentals: Only an entire lot with its house may be rented, and only to a single family. No renting of individual rooms or portions.
- Parking & vehicles: Trucks, buses, trailers, boats, campers, and similar vehicles are not allowed on lots unless screened from view of neighboring property and streets. Passenger cars and pickup trucks are permitted.
- Party walls: Walls constructed on or near lot lines are party walls shared by adjoining owners. Each owner is responsible for damage caused by their own act; shared damage is repaired equally. Exterior maintenance and painting of such walls must be in original colors.
- Enforcement & liens: The Association can place a lien on your lot for unpaid assessments or repair charges, with 8% interest and attorney's fees, and foreclose like a mortgage. Voting rights are suspended for owners 15+ days delinquent. Owners cannot claim homestead exemption against these liens.
