What Stetson Canal Condominium's governing documents say
Stetson Canal Condominium is a commercial condominium in Scottsdale, AZ — you own an office, retail, or restaurant unit within a mixed-use building. The association maintains common areas and enforces rules designed for an active, upscale commercial environment. This document applies to unit owners (businesses and investors) and their tenants.
- Permitted uses: Units are designated as Office, Retail, or Restaurant. Permitted uses include professional offices, financial institutions, general retail (unique identity, max one other US location), restaurants (unique identity, max one other location), and other compatible uses approved by Developer or Association. Street-level units must be Retail or Restaurant.
- Prohibited uses & conduct: No residential or medical office use. No gambling (except lottery), pawnshops, flea markets, labs (except photo/drug prep), funeral homes, bowling alleys, storage facilities, dry cleaning plants, sexually oriented businesses, junkyards, call centers, manufacturing, or nuisance-generating activities. Also prohibited: inebriate, disruptive, lewd behavior; nude or adult-oriented displays; and operation of equipment interfering with city communications.
- Leasing & transfers: All sales and leases require prior written approval from Developer (during control period) or Board, which cannot be unreasonably withheld. Association may charge a review fee. Leases must comply with condominium documents. Mixed Use Units have expedited review (7 business days) and no fee for lease approvals.
- Alterations & sign restrictions: Structural additions, alterations, or improvements require prior written approval from Developer/Board and a licensed engineer's certification. No exterior-visible alterations (including window coverings) without approval. Signs visible from outside are prohibited except as approved; political signs prohibited to fullest extent allowed by law. All window coverings must be solid earth-tone and approved.
- Parking: Parking is managed through Garage Reserved Spaces, Tandem Spaces, and Street Level Spaces. Developer/Board assigns parking spaces to units (see Exhibit D). Leasing income from unassigned spaces offsets common expenses. City has rights to Parking Garage; certain spaces are time-restricted.
- Hours of operation: Retail and Restaurant units must operate continuously seven days per week, except for up to four major holidays (e.g., July 4, Thanksgiving, Christmas, New Year's). Hours must be approved by Developer/Board.
- Patio restaurant specific rules: Patio Restaurants (using city-owned Patio Area) have additional restrictions: no outdoor cooking, no animals except service animals, removable fencing, lighting must minimize spillover, no outdoor music audible beyond 70 feet, no dancing, and must remove unruly persons. Violations may result in monetary sanctions and loss of patio license.
- Maintenance responsibilities: Association maintains common elements (walkways, landscaping, HVAC/access systems, public restrooms, etc.). Unit owners maintain their units and limited common elements (balconies, patios, signage). If owner fails to maintain, Association may do so and charge owner. Owners are liable for damage to common elements caused by their negligence or willful misconduct.
