Hacienda Del Este is a standard single-family home HOA community in Phoenix, AZ. The rules apply to all lot owners and their residents. This document is the full set of covenants, conditions, and restrictions governing the community.
- What you own & maintain: You own your lot and improvements on it, and you are responsible for their maintenance and repair. The Association maintains the Common Areas (Tracts A through I) and may also maintain landscaping on adjacent areas if the Board agrees.
- Assessments & fees: Annual assessments began at a maximum of $1,800 per lot and can be increased by the Board as needed. Special assessments require a 2/3 vote of all members. There is also a working capital fund payment equal to 1/6 of the annual assessment due upon purchase, and a transfer fee set by the Board when reselling to a non-builder/non-declarant.
- Leasing & rentals: Leasing a lot to a single family is permitted, but the owner must notify the Association of the lease term and tenant's name. There is no minimum lease term specified.
- Pets & animals: Only a reasonable number of generally recognized house or yard pets are allowed, kept solely as domestic pets and not for commercial purposes. No animal may create unreasonable noise or nuisance. Structures for animal confinement must not be visible from neighboring property.
- Parking & vehicles: No major automobile repairs or construction are allowed on lots or streets. Inoperable vehicles (e.g., with flat tires) must not be visible from neighboring property, common areas, or streets. Emergency repairs and temporary construction shelters are excepted.
- Signs: Signs are generally prohibited except for 'For Sale' or 'For Lease' signs subject to Board approval (unless otherwise provided). The Declarant has an exemption for sales-related signs during the development period.
- Use restrictions: All lots are restricted to single-family residential use. No commercial, professional, or trade activities are permitted. Temporary structures (trailers, tents, garages) cannot be used as residences. No further subdivision of lots is allowed without Board approval.
- Architectural control: Exterior paint and trim color changes require prior written Board approval. The Board also approves other improvements, signs, and utility structures. No buildings or structures may be moved onto the property without approval.
