What Merrill Ranch's governing documents say
This is a Declaration of Covenants, Conditions and Restrictions Regarding Use of Water for the Merrill Ranch master plan in Florence, Arizona. It is a standalone, ancillary document that governs the allocation and use of a specific groundwater right (Type 1 Right) for irrigation of the golf course (Poston Butte Golf Club) and a community park — it does not contain the full set of HOA rules for the community.
- Water usage priority: The Type 1 Right water must be used first for golf course landscaping on the Poston Butte Golf Club parcels, and second for landscape watering in the contiguous Merrill Ranch community park. In a shortage, the golf course gets priority.
- Assignment of water right: This Declaration does not assign any owner’s portion of the Type 1 Right. The Declarant (Pulte Home Company, LLC) retains the right for itself and subsequent owners.
- Reporting and payment of fees: The golf course owner (Golf Owner or successor) is responsible for reporting all water withdrawn and used under the Type 1 Right and must pay all associated groundwater withdrawal fees or similar charges.
- Duration and renewal: The Declaration continues as long as the golf course remains usable as a golf course. If perpetual effect is unenforceable, it lasts 99 years from the date of the Declaration (January 28, 2021), with automatic 25-year extensions unless extinguished by amendment.
- Amendment process: Amendments, including extinguishment of the Declaration, require the express approval of both the Declarant and owners of 90% of the acres within the Property. Recorded amendments become effective upon recording.
- Enforcement: The Declarant and any owner of the Property or the Golf Owner may enforce the Declaration to ensure delivery of water under the Type 1 Right to the golf parcels, as allowed by law.
