Hacienda Real Homeowners Association is a non-profit corporation established in 1979 in Phoenix, Arizona to own and maintain common property for lot owners. This document is the corporate charter (Articles of Incorporation) that defines the legal structure of the association, not the actual community rules — the specific restrictions, fees, and regulations are in a separate Declaration of Covenants, Conditions and Restrictions.
- Membership & voting rights: Every lot owner is automatically a member. Each owner votes based on the number of lots owned. The developer (Declarant) initially held Class B voting power with three votes per lot, but this converts to standard Class A voting (one vote per lot) when Class A members outnumber Class B members by one, on June 1, 1982, or when the developer voluntarily relinquishes the advantage — whichever comes first.
- Board of Directors: The association is run by a Board of 2 to 7 directors. At least one director must be an Arizona resident, but directors do not need to be association members. The first Board was elected in November 1979; annual elections are held on November 9.
- Assessments: The association levies annual assessments against each lot and owner to fund operations. The specific amounts and procedures are set out in the Declaration, not in this document.
- Voting suspension for non-payment: If a lot owner falls behind on payments or breaches the Declaration, their voting rights and access to common areas may be suspended until all arrears and defaults are cured.
