Hermosa Inn is a timeshare resort in Phoenix, AZ. Owners buy a fractional undivided interest (1/1785th) in the property, giving them the right to reserve and use a unit of their unit type for up to seven use days per year. This document is the main rulebook for owners, covering use rights, restrictions, and association governance.
- Ownership & use rights: Each timeshare is an undivided 1/1785th interest in the property. Owners may reserve up to 7 Use Days per year (consecutive or separate) for a unit of their type (Villa, Hacienda, or Casita). Use days expire each year and cannot accumulate.
- Occupancy & reservation rules: Reservations are made per the Rules & Regulations. A reservation including Friday or Saturday must include both, and only one such period per year. Maximum occupancy per unit is set by the Rules. Owners must vacate by check-out time; failure to vacate results in penalties including 200% of fair rental value per day.
- Pets & alterations: No animals are allowed in any unit or common area. Owners may not make alterations, additions, or redecorations to units or common furnishings without prior written consent of the association.
- Assessments & fees: Owners pay Basic Assessments for operating expenses (determined annually) and may be subject to Special Assessments. Personal charges (damage, long-distance calls, etc.) are billed separately. Assessments are levied per timeshare.
- Leasing & rentals: Only the Declarant (developer) may rent units to the public during unreserved periods. Individual owners cannot rent their units except through the managing agent under separate agreement. The association may rent units if the Declarant defaults on assessments.
- Transfer & mortgages: An owner cannot sell or encumber less than their full interest in a timeshare. A mortgage may be placed only on the entire timeshare, and is subordinate to this declaration. Partition of the property is prohibited except between co-owners of the same timeshare.
- Voting & association control: Each timeshare gets one vote; the Declarant initially holds Class B membership with two votes per timeshare until its voting power drops below 20%. The board is elected by members, with at least one director elected solely by non-Declarant owners.
