The Home Owners Association (HOA) governs through this Declaration of Covenants, Conditions and Restrictions, binding all owners, residents, and tenants. Owners own their lot and home, but the association maintains common areas, streets, and designated front yards, funded by quarterly assessments.
- Architectural review: Any exterior change (painting, additions, landscaping, satellite dishes) requires prior written approval from the Design Review Committee. Applications are deemed disapproved if not acted on in 45 days; resubmissions get 30 days. Fees may apply. Exterior painting must occur every 7 years, and colors must follow an approved palette. No metal awnings, reflective materials, or visible mechanical equipment are allowed.
- Use restrictions: Each lot is limited to one single-family attached patio home, no commercial, business, religious, or institutional use. No temporary structures, trailers, tents, or outbuildings as residences. Garage/estate sales are prohibited. No signs except one temporary 'for sale' sign under 5 sq ft. No clotheslines, storage piles, or bulk trash visible. No burning trash.
- Rentals & guests: Renting, exchanging, or leasing a patio home is prohibited. Only temporary house-sitting by family members is allowed, subject to board notification and approval if over one month or if not a family member.
- Pets: Commonly accepted household pets in acceptable numbers may be kept, not for commercial purposes. Owners must follow Phoenix leash laws and clean up after pets.
- Parking & vehicles: No trucks (except standard pickup), buses, trailers, boats, or campers may be parked on the lot. Vehicles normally resident must fit in the garage and be parked there except briefly. No overnight parking of such vehicles on premises. Large vehicles may park on Georgia Street (public street) south of the community. Guest parking is limited and subject to board discretion.
- Assessments & fees: Annual and special assessments are levied uniformly per lot (1/16th share). Assessments are due quarterly. Delinquency begins 30 days after due date, with interest at the highest legal rate, and creates a lien on the lot subordinated to first mortgages. No owner can waive assessments by not using common areas.
- Maintenance responsibilities: The Association maintains common areas, streets, designated front yards, landscaping, and parking areas. Owners are responsible for all exterior elements of their home (stucco, paint, roofs, windows, doors) and interior maintenance, including termite control. Exterior painting is required every 7 years. If owner-caused damage occurs, the owner must repair or reimburse the Association.
- Party walls: Rights and duties for party walls (walls on lot lines) are defined. If one owner damages a party wall, they must rebuild at their cost. If damage is from other causes, adjoining owners share cost equally. Any modification to a party wall requires written consent from the adjoining owner and Design Review Committee.
