Casa Tierra is a single-family home community (HOA) in Phoenix, AZ. You own your lot and attached building; the association owns and maintains the common areas (swimming pool, parking, walks, etc.). Every owner automatically becomes a member of the Casa Tierra Property Owners’ Association and is subject to its covenants, assessments, and architectural controls.
- What you own & maintain: You own your lot and the building on it. The association maintains the common area (tracts A–D shown on the plat), including recreational facilities, parking, landscaping, and utilities. You are responsible for interior decorating and for any damage your alterations cause to other lots or common area.
- Assessments & fees: Regular assessments are set annually by the board, shared equally among all lots (improved vs. unimproved lots pay different rates initially). Special assessments require two-thirds approval of each membership class. The maximum regular assessment per improved lot starts at $1,000/year and can increase each year by the CPI change without a vote; larger increases need a 2/3 vote. Delinquent assessments bear 6% annual interest and become a lien on the lot.
- Architectural review: Any exterior alteration, addition, or change visible from neighboring property (including landscaping and paint color) requires prior approval from the board or an architectural committee. The board may adopt rules for design review. Applications are deemed approved if not acted on within 30 days of a complete submission.
- Party walls: Walls built on lot dividing lines are party walls. If damaged by an owner's act, that owner repairs at their own cost; if damaged by other causes, adjoining owners share costs equally. Any modification affecting a party wall requires consent of all affected owners and prior approval from the board or architectural committee.
- Use restrictions: Each lot is limited to ‘Single Family Residential Use,’ defined as one or more related persons or a group of up to four unrelated persons living together as a household. The association may adopt rules for the common area (e.g., limiting guests, charging fees). Violations can result in suspension of voting rights and common-area use for up to 60 days.
- Developer transition: The developer (Lemon Tree Village, Inc.) retains Class B voting membership (3 votes per lot owned) until the earliest of: Class A votes equal Class B votes, December 31, 1987, or 30 days after developer's conversion notice. The developer may also add up to 104 total lots via supplemental declarations within three-year windows.
