Evans Addition To Orangewood is a condominium (Horizontal Property Regime) in Phoenix, AZ. These By-Laws govern the unit owners' association, including voting, board structure, maintenance obligations, and use rules. The document applies to all present and future owners, tenants, and users.
- Governance & voting: Each unit owner has one vote per unit. A 'majority of owners' means 51% of votes. Quorum for owners' meetings is a majority in person or by proxy. Annual meetings held second Monday in April. Board of Directors has 3–9 members, all unit owners, elected for staggered 3-year terms.
- Assessments: Owners pay monthly assessments set by the Association, pro rata according to unit value as declared in the Declaration of Horizontal Property Regime. Assessments cover common expenses, including liability and hazard insurance.
- Maintenance & repairs: Owners are responsible for all interior maintenance and repairs (water, light, gas, sewage, telephone, AC, doors, windows, etc.) and must promptly fix issues that could affect the project. The Association handles exterior maintenance (roofs, gutters, exterior surfaces, private sewers/water lines from stub-out to public connection, and private drives).
- Alterations: No structural modifications or alterations may be made without notifying the Association in writing. The Association must respond within 15 days; silence means no objection.
- Parking: Each unit is entitled to use up to two parking spaces, assigned by the Association, with ingress/egress rights over the parking area.
- Rules of conduct: No posting advertisements or posters without authorization. Residents must avoid disturbing noises and musical instruments. Domestic animals are permitted subject to Association rules. No hanging garments or rugs from windows/façades, no dusting or beating rugs on exterior, no throwing garbage outside designated areas. No exterior wiring, antennae, or AC units without approval.
- Right of entry: Owners must grant entry to management or authorized persons in emergencies. For non-emergency repairs to mechanical/electrical services, entry is allowed with advance request at a convenient time.
- Amendments: By-Laws may be amended by a vote of owners representing at least 75% of total unit value. Article VIII (parking rights) cannot be rescinded or amended without written approval of all mortgagees.
