Peachtree Lane is a 36-unit condominium community (horizontal property regime) in Phoenix, AZ. You own your individual unit's interior and an undivided 1/36th share of the common elements, which the association maintains and insures. The declaration governs use, assessments, architectural control, and party-wall rights.
- Residential use only: All units are limited to residential purposes. No business, professional, commercial, religious, or institutional uses are allowed (except association activities).
- Pets: Only commonly accepted household pets are allowed, not bred or kept for commercial purposes. The board may regulate the number and kind of pets. Pets must not be loose or unsupervised; walking allowed only where the board prescribes.
- Leasing & short-term rentals: Only an entire unit may be rented, and only to a single family. Renting a portion of a unit is prohibited. No minimum lease term is specified, but short-term/vacation rentals (partial unit) are effectively banned.
- Architectural review: All exterior changes (structures, fences, landscaping, painting, awnings, antennas, etc.) require prior written approval from the board (or developer before transition). Plans submitted are deemed approved if not rejected within 30 days. The board may deny for aesthetic or any reason.
- Parking & vehicles: No trucks, buses, vans, trailers, boats, campers, or similar vehicles may be kept or parked in streets or driveways unless in garages or board-approved areas. Passenger automobiles and station wagons are exempt. Motorcycles or other vehicles creating loud noise may be prohibited. Garage doors must be kept closed except for ingress/egress.
- What you own & maintain: Your unit includes the interior space (finished floor to ceiling, interior wall surfaces), patio, heating/AC unit, and garage. The association maintains common elements (land, buildings, roofs, walls, floors, recreational facilities, utilities, landscaping). You maintain your unit interior; the association may maintain exterior visible portions if approved by members.
- Assessments & fees: Each unit pays an equal 1/36th share of annual assessments (covering taxes, insurance, maintenance, reserves) and special assessments (for capital improvements, requiring 2/3 member vote). Assessments are a personal obligation and a lien on the unit. Late payments may incur interest, costs, and attorney fees.
- Party walls: Walls on the dividing line between units are party walls. Damage caused by one owner (or their guests) must be repaired at that owner's cost. Damage from wear-and-tear or other causes is split equally. Modifications require written consent from the adjoining owner. Disputes go to arbitration.
