Kaufman and Broad at Desert Canyon is a planned community of attached/townhome-style homes (with party walls) in Phoenix, AZ. This declaration governs all lots and common areas, binding owners, occupants, and tenants. It sets rules for land use, assessments, design control, and maintenance to protect property values.
- Leasing & rentals: No lease may be for less than 30 days. Owners must ensure tenants comply with all governing documents and are liable for tenant violations.
- Pets & animals: Only a reasonable number of generally recognized house pets are allowed, as determined by the Board. Pets must not cause annoyance or nuisance to neighbors. No commercial keeping of animals.
- Assessments & fees: Each lot pays equal monthly assessments. The maximum annual assessment for 1994 is $15.00 per month per lot. Annual increases are limited to the greater of CPI or 10%, plus insurance and utility cost increases. Special assessments require 2/3 vote of each membership class. - Party walls & shared maintenance: Owners of adjoining lots with shared walls (party walls) share equal rights and maintenance obligations. Damage caused by an owner is that owner's responsibility; damage from other causes is shared proportionally. Disputes are resolved by the Committee or Board.
- Landscaping & maintenance: Owners must landscape their lot within 90 days of purchase and maintain landscaping and exterior in neat condition. Reconstruction of damaged structures must be completed within 18 months. No accumulation of debris or weeds.
